This research aims to analyze and to respond to the particularly in the light of democratic development prospect. The main topic raised in this research is the implementation of constitution 1945 (uud 1945) which is established as a supreme law which constitutionally bounds by PPKI (Indonesia committee for indepence) that has been amended four times. One of major decisions in the amandements agreed by house of representatives MPR in general assembly in 1999 is to enforce presidential system.The development of democracy in Indonesia itself has been a growing process until now. The development has shown that Indonesia is undergoing a change directing to a certain democratics systems. To respon the raised issue, this research use normative methods in other words, the research relies on library study amd field work. Some theories are used as analytical foundation to this research. They are constitutional theory as grand theory, democratic theory as middle range theory and law country and separation and division power as applied theories. The research shows that governmental system of republic Indonesia is purely presidential system, in which president and vice president is directly by the people. Parliamentary system employs soft bicameral system. Even it can be considered as parliamentary system with three chambers that is house of represent legislature DPR, provincial representatives (DPD) has its own authority governmenial system in the democratic development one from is giving chances the people to choose president and his assistenes directly.
